The ATO is not your enemy!

However, this is not true at all. The ATO collects taxes for the good of Australia, and it wants businesses to stay open. Many businesses find, when starting an ATO tax debt negotiation, that very reasonable terms can be agreed on. Business owners that put off dealing with their ATO tax debt, under the assumption that it’s going to put them into hardship are often disappointed with themselves – they could have saved themselves so much stress by just getting it done!

What Happens If I Leave

Things Too Late?



The ATO will act in good faith as far as possible. If you have ATO tax debt, the first action it will take will be to send “friendly” (as friendly as these things can be) reminder notices. If you ignore these and refuse to contact the ATO to negotiate, you’re eventually going to be sent a Director Penalty Notice. This is a significantly less pleasant document and is essentially notice that the ATO is going to pursue you personally for your company’s unpaid debts. Worst case scenario, they will estimate your tax lodgements for you and then pursue you personally for the taxes owed. Not a situation you’d like to find yourself in!


Significantly, putting the company into administration at this point will not prevent the ATO from reclaiming what it is owed. The Director Penalty Notice transfers the debt to the individual, meaning that, at that point, your personal assets can be garnished or claimed by the ATO to make good on the debt.


If you get served with one of these notices, you should contact us right away. There are still pathways out of the trouble that you’re in, but you need to act fast as you only have 21 days from the point that the Director Penalty Notice is sent to act on it before the ATO will take further action.

Our Three-Step Process



Our process for helping you deal with your ATO tax debt is done in three stages:

Firstly, we will conduct an emergency tax review. In that, we will seek to do two things: assess your real ATO tax debt liabilities and analyse your legal obligations.
